Terms and Condition of Use

This website is set up and run by an unincorporated group of Catholics interested to promote informed and responsible discussion in the Catholic Church, especially in the USA.

When using the Website and its services you agree to these terms and conditions listed on this web page (Terms and Conditions of Use). CathNewsUSA may from time to time amend, update or change this Website including these Terms and Conditions of Use without prior notice.

1. General Disclaimer

1.1. CathNewsUSA is not liable to you or anyone else for any loss suffered in connection with the use of this Website or a linked website.

2.1. This Website is CathNewsUSA’s intellectual property and is subject to copyright.

4.3. If you believe any Third Party Information to be inaccurate, incomplete or out of date, defamatory, infringing intellectual property rights or generally injurious to you or any party, you should contact CathNewsUSA.

5. Your Postings

5.1. You may post reviews, comments and other comments on the Website or submit suggestions, ideas, comments, questions or other information to CathNewsUSA  by email or other means including comment posts.

5.2. The content of your Posts must not be illegal, obscene, threatening, defamatory, invasive of privacy, infringing intellectual property rights or otherwise injurious to third parties and must not consist of or contain any computer viruses, political campaign messages, commercial solicitation; chain letters, mass mailings, or any form of SPAM.

5.3. As we are attempting to foster a transparent and constructive dialogue regarding Catholic issues, we strongly suggest that people who post comments have the courage of their convictions and use their real names and not pseudonyms or abbreviations. When submitting a Post, you must not use an email address that you do not own or control, impersonate any other person or entity, or otherwise be misleading as to the origin of the Post. We also expect those who comment to do so in a spirit of Christian kindness and charity. CathNewsUSA reserves the right–at their own discretion–to remove any comments or block any users who do not adhere to this standard.

5.4. Where you submit a Post, you expressly grant CathNewsUSA a nonexclusive, royalty-free, perpetual, irrevocable and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content throughout the world in any media.

5.5. You represent and warrant to CathNewsUSA that:

(a) you have the right to:

(i) use and publish the content of your Posts; and

(ii) allow CathNewsUSA to use the content of your Posts pursuant to these Terms and Conditions of Use;

(b) the content of your Posts is accurate and not defamatory, and does not infringe the intellectual property rights of third parties; and

(c) the use and publish of the content of Post by you will not breach any term of these Terms and Conditions of Use.

5.6. You will indemnify CathNewsUSA and keep CathNewsUSA indemnified against all claims, damages, loss or injury as a result of you breaching any:

(a) warranties contemplated by clause 6.5; or

(b) other of these Terms and Conditions of Use.

5.7. You acknowledge and agree that:

(a) CathNewsUSA may edit or remove the content of any Posts, but is not obliged to do so; and

(b) CathNewsUSA has no responsibility or liability to you for the content of any Posts, whether posted by you or any other party.

6. Advertisement and other third party postings

6.1. CathNewsUSA may from time to time allow third parties to post advertisement, reviews, hyperlink or other information on the Website (Third Party Listings).

6.2. You acknowledge and agree that CathNewsUSA is not obligated to monitor or verify information on the Third Party Listings.

6.3. Nothing in theses Terms and Conditions of Use and nothing that CathNewsUSA may say and do can be construed as endorsing the content of (or part of) any Third Party Listings.

6.4. Where the content of any Third Party Listing is inaccurate, incomplete or out of date, defamatory, infringing intellectual property rights or generally injurious to you or any party, and you suffer a damage or loss as a result, then to the extent permitted by law, you release and hold CathNewsUSA harmless against such damage or loss.

7. Exclusion of Warranties

10.1. These Terms and Conditions of Use are governed by the laws of the United States and in any disputes between you and CathNewsUSA, you agree to submit to the exclusive jurisdiction of the courts of the United States.

11. Severability

I requested the change by using the “subscribe” button at the bottom of the newspage, but so far I have not received it at my Gmail address. I plan to unsubscribe my Hotmail address as soon as I see that the new address has been activated. Can you help me?

    I see my most recent comment is subject to review. Is this a sentence imposed on me alone or on everybody?
    Assuming it is for me alone, why? I understand you, as the owner, can determine what really appears but I think it would be the Christian thing to do to tell me what is objectionable.

    You have two commenters — Tony and Andrew — who constantly bicker back and forth. At times, they are almost abusive towards each other. But yesterday in a comment Andrew really crossed the line (in my opinion) by calling Tony “excrement”. It seems to me that this violates one of your terms of use: “We also expect those who comment to do so in a spirit of Christian kindness and charity. CathNewsUSA reserves the right–at their own discretion–to remove any comments or block any users who do not adhere to this standard.” I hope you will monitor the future comments of these two men and remind them that if they do not agree with each other, they should do so with kindness. The way they react to each other is not going to bring converts to the Catholic faith which professes to follow the way of Jesus.
